Welcome to the UNIMAS Official Merchandise Store ("Store").

The Store is operated by UNIMAS Holdings Sdn. Bhd. ("UHSB", "we", "us" or "our"), the commercial arm of Universiti Malaysia Sarawak (UNIMAS).

By accessing or using this website, placing an order or purchasing any product through the Store, you agree to be bound by these Terms of Service ("Terms").

If you do not agree with these Terms, please do not use the Store.

1. ABOUT THE STORE

The UNIMAS Official Merchandise Store offers official merchandise, apparel, accessories, lifestyle products, collectibles and other products associated with Universiti Malaysia Sarawak.

The Store may offer products through online and offline sales channels.

2. ELIGIBILITY

You may use the Store if you are legally capable of entering into a binding contract under applicable Malaysian law.

If you are below the applicable age of majority, you should only place an order with the involvement and consent of a parent or legal guardian where required by law.

3. PRODUCTS AND PRODUCT INFORMATION

We endeavour to ensure that product descriptions, images, colours, sizes, dimensions and specifications displayed on the Store are accurate.

However:

  • actual product colours may vary depending on your device or screen settings;

  • minor variations may occur due to manufacturing processes;

  • product images may include styling or accessories that are not included in the purchase;

  • product specifications may be changed where necessary without prior notice.

We reserve the right to correct errors, update product information or withdraw products from sale at any time.

4. PRICES

All prices displayed on the Store are in Malaysian Ringgit (RM) unless otherwise stated.

Prices may be changed at any time before an order is accepted.

Where applicable, taxes, delivery charges, payment processing charges or other applicable fees will be displayed before checkout.

5. ORDERS

When you place an order, you are making an offer to purchase the selected products.

An order is not considered accepted until we have:

  1. received your order;

  2. confirmed product availability;

  3. received or authorised payment; and

  4. issued an order confirmation or otherwise confirmed acceptance.

We reserve the right to reject or cancel an order where:

  • the product is unavailable;

  • there is an obvious pricing or product description error;

  • payment cannot be verified;

  • fraudulent or suspicious activity is suspected;

  • the order contains inaccurate information; or

  • circumstances beyond our reasonable control prevent fulfilment.

If we cancel an order after payment has been received, the applicable amount will be refunded.

6. PAYMENT

Payments may be processed through third-party payment providers made available through the Store.

We do not generally store complete payment card information on our own systems.

You are responsible for providing accurate payment information and ensuring that you are authorised to use the selected payment method.

7. DELIVERY

We will endeavour to dispatch orders within the estimated processing period stated on the Store.

Delivery times may vary depending on:

  • destination;

  • courier availability;

  • public holidays;

  • peak sales periods;

  • product availability; and

  • circumstances outside our reasonable control.

Delivery estimates are not guaranteed delivery dates unless expressly stated otherwise.

Customers are responsible for providing a complete and accurate delivery address.

8. CLICK & COLLECT / OFFLINE COLLECTION

Where Click & Collect or other collection options are offered, customers must follow the collection instructions provided with their order.

Customers may be required to provide:

  • order number;

  • identification;

  • proof of purchase; or

  • other reasonable information required to verify the order.

Orders not collected within the specified collection period may be subject to additional arrangements or cancellation.

9. PRODUCT AVAILABILITY

All products are subject to availability.

Limited-edition and special collection products may have limited quantities and may not be restocked.

We do not guarantee that a product will remain available after it has been added to a customer's cart.

10. REFUNDS, RETURNS AND EXCHANGES

Returns, exchanges and refunds are governed by our Refund & Returns Policy, which forms part of these Terms.

Customers should review the Refund & Returns Policy before placing an order.

Nothing in our policies is intended to exclude or restrict any rights or remedies that cannot lawfully be excluded under applicable Malaysian law.

11. INTELLECTUAL PROPERTY

All trademarks, logos, product designs, photographs, graphics, text, artwork, website content and other intellectual property displayed on the Store are owned by or licensed to UHSB, UNIMAS or the relevant rights holder.

You may not reproduce, modify, distribute, publish, sell or commercially exploit any Store content without prior written permission.

The UNIMAS name, logo and related marks may only be used in accordance with applicable brand and intellectual property requirements.

12. USER CONTENT

If the Store allows customers to submit reviews, photographs, comments or other content, you agree that:

  • the content is accurate to the best of your knowledge;

  • you have the necessary rights to submit the content;

  • the content does not infringe another person's rights;

  • the content is not unlawful, defamatory, offensive or misleading; and

  • the content does not contain malicious code or harmful material.

We reserve the right to remove content that violates these requirements.

13. PROHIBITED USE

You must not use the Store to:

  • engage in fraudulent activity;

  • interfere with the operation or security of the Store;

  • attempt unauthorised access;

  • introduce malicious software;

  • scrape or harvest information without permission;

  • impersonate another person or organisation;

  • misuse promotional codes or discounts; or

  • conduct any activity that violates applicable law.

14. THIRD-PARTY SERVICES

The Store may integrate with third-party services, including payment processors, courier providers, technology providers, analytics services and other service providers.

Your use of third-party services may be subject to their own terms and privacy policies.

We are not responsible for the content, availability or practices of third-party websites or services outside our control.

15. LIMITATION OF LIABILITY

To the extent permitted by applicable law, UHSB will not be responsible for indirect, incidental, special or consequential losses arising from your use of the Store.

Nothing in these Terms excludes liability that cannot legally be excluded or limited under Malaysian law.

16. FORCE MAJEURE

We will not be liable for delays or failure to perform our obligations caused by circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, industrial disputes, system failures, courier disruptions, telecommunications failures or other similar events.

17. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The latest version will be published on this website with the applicable "Last Updated" date.

Your continued use of the Store after changes are published constitutes acceptance of the updated Terms, to the extent permitted by law.

18. GOVERNING LAW

These Terms are governed by the laws of Malaysia.

Any dispute arising from the use of the Store shall be subject to the applicable laws and jurisdiction of Malaysia.
